These Terms of Service (the Terms) are a binding agreement between you and Tribute.tips (Company, we, us, or our). They govern your access to and use of tribute.tips, its related webpages, accounts, intake forms, booking tools, payment features, messaging, tributes, reviews, and other services we make available (collectively, the Service).
In these Terms, a Follower is a customer who uses the Service to view Creator profiles, complete a Creator intake form, request or purchase sessions, communicate about bookings, send an eligible Tribute, or submit a review. “Follower” is an account-role label and does not imply a subscription, endorsement, employment relationship, or recurring payment.
Please read these Terms before using the Service. By creating an account, selecting an unchecked box stating that you agree, submitting a booking or tribute, or otherwise using the Service, you agree to these Terms and consent to transact electronically. If you do not agree, do not use the Service.
1. Launch Model: Tribute.tips Is the Sole Seller
During the launch phase covered by these Terms:
- Tribute.tips operates as a single-merchant business.
- Every creator profile and service offer displayed on the Service is selected, controlled, and administered by the Company as part of its own agency operations.
- The Company—not the individual displayed on a creator profile—is the seller and contracting party for every paid booking and tribute.
- The Company sets or approves prices, accepts Follower payments into its own Stripe account, issues receipts, manages fulfillment, handles customer support, and decides refunds and disputes.
- A person who appears on a creator profile (a Creator) performs an authorized service for or on behalf of the Company. A Creator is not a separate merchant, marketplace seller, Stripe connected account holder, or owner of any Follower payment by reason of appearing on the Service.
- The Service does not provide creators or Followers with stored-value accounts, wallets, escrow accounts, withdrawal rights, or peer-to-peer transfers.
If we later permit independent third-party creators to sell through Tribute.tips or receive payments through Stripe Connect or another payout service, we will first introduce separate or amended terms, disclosures, onboarding, and acceptance procedures. Nothing in these Terms authorizes that future model.
2. Eligibility and Geographic Scope
You must be at least 18 years old and legally capable of entering a binding contract to use the Service. By using the Service, you represent that you satisfy those requirements.
The Service is currently intended for users who are 18 or older in the United States. We may restrict access based on location, legal requirements, payment availability, sanctions, fraud risk, or operational capacity. Unless clearly stated otherwise at checkout, prices are displayed and charged in U.S. dollars.
The Service is not directed to anyone under 18. If you become aware of an underage account, contact legal@tribute.tips.
3. Accounts and Account Security
You agree to:
- provide accurate, current, and complete registration and booking information;
- maintain only accounts you are authorized to use;
- keep your password, authentication codes, and devices secure;
- promptly update information that becomes inaccurate;
- notify us promptly at support@tribute.tips of suspected unauthorized access or payment activity; and
- comply with identity, email, payment, fraud, or age checks we reasonably require.
You may not sell, transfer, share, or impersonate another person through an account. You are responsible for activity conducted through your account to the extent permitted by law. We may require email verification or multi-factor authentication and may suspend access while investigating a security concern.
4. What the Service Provides
Tribute.tips allows eligible Followers to:
- view Company-operated creator profiles and approved offers;
- answer a Creator-authored intake form and, after signing in with a verified Follower account, submit the response to that Creator;
- request and pay for scheduled one-to-one sessions;
- submit custom requests for Company review or response;
- communicate through booking-linked messages;
- send an optional one-time tribute where enabled; and
- submit an eligible review after a completed, paid, non-refunded, and undisputed session.
For each transaction, the applicable offer page, checkout, or confirmation will identify the Creator, service description, duration, date or scheduling method, price, currency, and material delivery conditions. Those transaction-specific details form part of these Terms.
Availability is not guaranteed until a booking request is accepted. A custom request does not create a booking or payment authorization until you approve a resulting offer and complete checkout.
An intake-form response is informational only. Submitting one does not create a booking, require a Creator response, authorize a payment, reserve availability, or guarantee that the Company or Creator will provide a service.
Company personnel may administer profiles, scheduling, and support. The person assigned to perform a confirmed session will be identified in the applicable profile, offer, or confirmation. We will not knowingly present an automated or staff communication as personally authored by someone else.
5. Booking Requests and Confirmation
5.1 Payment authorization submits a request
When you submit a booking request, you authorize the Company and Stripe to place a temporary authorization on the payment method you selected for the full amount displayed at checkout. An authorization may appear as pending and may temporarily reduce available funds, but it is not a completed charge. The request and authorization do not guarantee that the session is confirmed.
5.2 Company response and Creator availability
The authorized Creator generally has up to 24 hours to accept or reject an authorized booking request. The period may be shorter when the requested session begins sooner, as indicated by the Service. We may also reject a request for availability, safety, compliance, payment, sanctions, fraud, or operational reasons.
5.3 Acceptance
If the request is accepted, the Company will instruct Stripe to capture the authorized total, the booking becomes confirmed, and we will provide a confirmation through the Service or by email. You are responsible for reviewing the time, time zone, delivery method, duration, and instructions. If an authorization cannot be captured, the booking is not confirmed unless the Company provides another written confirmation after resolving payment.
5.4 Rejection or expiration
If the request is rejected or expires without acceptance, the Company will cancel the authorization rather than capture it. Your bank or card issuer controls how quickly a pending authorization disappears. If a payment was exceptionally captured before cancellation, the Company will instead initiate a full refund of the captured total, including the platform booking service fee.
5.5 Messaging
Creating a booking and completing its payment authorization may activate booking-linked messaging before final acceptance so the parties can coordinate the request. Rejection, expiration, cancellation, release of an authorization, or refund does not automatically end that conversation. Messaging may still be restricted for safety, moderation, legal, account-security, or abuse-prevention reasons. Messaging is not an emergency or crisis service.
6. Payments, Stripe, Taxes, and Receipts
6.1 Payment processor
The Company uses Stripe to process card and other eligible payment methods. Stripe may collect payment, billing, device, browser, fraud-prevention, and transaction information under its own terms and privacy policy. Full card numbers and card security codes are submitted to Stripe, not intended to be stored on Tribute.tips servers.
6.2 Authorization
By providing a payment method, you represent that you are authorized to use it and authorize the Company and Stripe to authorize and, after Creator acceptance, capture the displayed total, including applicable taxes and the clearly disclosed platform booking service fee. If you choose to save a payment method, you authorize its use for later transactions that you separately initiate.
6.3 Platform booking service fee
For each session booking, the checkout adds a platform booking service fee equal to 10% of the displayed session price. For example, a $50.00 session has a $5.00 platform booking service fee and a $55.00 USD total. This fee is charged by Tribute.tips for operating the booking service; it is not a card surcharge, Stripe fee, gratuity, Tribute, or amount paid to a Creator. It applies regardless of which eligible payment method is used. If the booking is rejected, expires, or is canceled or refunded under these Terms, the full platform booking service fee is canceled or refunded together with the session price.
6.4 Currency and taxes
Unless checkout expressly states otherwise, charges are in U.S. dollars. Applicable taxes, if any, will be disclosed or included as required by law. You are responsible for any fees charged by your bank, card issuer, or payment provider, including currency-conversion or insufficient-funds fees.
6.5 Statement descriptor
Unless the checkout or receipt displays a different descriptor, a charge should appear on your statement as TRIBUTE.TIPS. Contact support@tribute.tips promptly if you do not recognize a charge.
6.6 Receipts
We will provide an electronic receipt or payment record through email, your account dashboard, or both. You are responsible for keeping your contact information current.
6.7 Failed or disputed payments
We may decline, cancel, or pause a transaction based on processor responses, fraud indicators, sanctions, legal requirements, or account risk. Before initiating a card dispute, please contact support@tribute.tips so we can try to resolve the issue. This request does not waive any right you have under applicable law or card-network rules.
6.8 One-time charges; no automatic renewal
Each booking and Tribute is a one-time charge. Tribute.tips does not automatically renew or charge a subscription unless you separately and expressly enroll in a recurring plan that we may introduce in the future after providing the required terms and consent process.
7. Cancellations, Rescheduling, and Refunds
This Section is the Company’s fulfillment and cancellation policy for scheduled services.
7.1 Rejected or unanswered booking requests
A request that is rejected or not accepted within the applicable response window has its payment authorization canceled. If the total was already captured, the Company will issue a full refund, including the platform booking service fee, to the original payment method.
7.2 Company-side cancellation or Creator unavailability
If the Company or assigned Creator cannot provide a confirmed session, we will offer you a choice between a reasonable rescheduling option and a full refund. If you decline rescheduling, we will initiate the full refund. If a material technical failure under our control prevents delivery and cannot reasonably be cured or rescheduled, we will provide an appropriate refund.
7.3 Follower cancellation
You may automatically cancel a future booking through the account tools until one minute before its scheduled start time. No separate cancellation fee applies. If payment has not been captured, the authorization will be canceled. If payment has been captured, the Company will initiate a full refund of the displayed total, including the session price and platform booking service fee, to the original payment method. At or after the one-minute cutoff, automated cancellation is unavailable; contact support@tribute.tips regarding an exceptional issue.
This policy does not limit any refund or cancellation right that cannot lawfully be waived.
7.4 Rescheduling
A request to reschedule is not confirmed unless the Company approves it in writing or through the Service. Availability is not guaranteed. If no replacement time is agreed, the original booking remains in effect unless canceled under this Section.
7.5 Follower lateness or nonattendance
If you do not attend or are unavailable at the scheduled time and the Company was ready to provide the session, no automatic refund is due. We may consider documented exceptional circumstances in our discretion and as required by law.
7.6 Service concerns
If you believe a session was not delivered as described, contact support@tribute.tips as soon as reasonably possible and preferably within seven days. Provide the booking reference and a factual description. We may request relevant records and may offer a reschedule, partial refund, full refund, or other resolution based on the circumstances. The preference for prompt notice does not shorten a non-waivable legal right.
7.7 Refund timing and method
Approved refunds are sent to the original payment method. They commonly take several business days to appear, but timing depends on Stripe, the card network, and your financial institution. A canceled authorization is not a refund and may disappear on a different schedule set by your issuer. We cannot provide cash, send a refund to a different person or payment method, or guarantee an issuer’s posting date.
8. Voluntary Tributes
Where enabled, a Tribute may be offered only after the Company has provided the Follower with a bona fide service. It is an optional, one-time gratuity paid solely to Tribute.tips in appreciation of that completed service and the work presented through an agency-operated Creator profile.
A Tribute:
- is not a charitable donation and is not tax-deductible as a charitable contribution;
- is not a personal gift, peer-to-peer transfer, escrow deposit, or payment to an individual Creator or Creator-owned account;
- is not consideration for content, access, attention, a response, a message, a future service, or any other additional benefit;
- does not create a Follower balance, Creator balance, withdrawal right, ownership interest, or creditor relationship;
- is received and controlled by the Company as the sole merchant; and
- is subject to the minimum, maximum, currency, and other conditions displayed at checkout.
Unless required by law or card-network rules, Tributes are generally final after successful processing. We may refund a duplicate, unauthorized, erroneous, or otherwise exceptional Tribute in our discretion after review. Tribute messages must comply with these Terms.
The availability of Tributes may be limited, suspended, or disabled based on Stripe approval, payment-network requirements, law, fraud risk, or Company policy.
9. Communications and Session Delivery
You agree that we may send transactional communications needed to administer your account, security, intake-form submissions, bookings, payments, refunds, disputes, and legal notices. Marketing communications, if any, will include the choices required by law.
Sessions may be delivered through the method shown in the offer or confirmation, which may include a third-party video, voice, messaging, or social platform. Your use of a third-party service is subject to that provider’s terms and privacy practices. Do not share payment-card details, government identification numbers, passwords, or unnecessary sensitive information with a Creator.
You may not record a session without the prior express consent of every participant and any Company approval required by law or policy.
10. User Content, Reviews, and Public Profiles
User Content includes intake-form questions and responses, text, messages, reviews, reports, images, links, and other material you submit.
You retain the rights you hold in User Content. You grant the Company a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, and transmit User Content only as reasonably necessary to operate, secure, moderate, and improve the Service and to comply with law. For content you expressly submit for public display, you also grant us permission to display, distribute, and promote that public content in connection with the Service. Private messages are not treated as public or promotional content, but authorized personnel may access them when reasonably necessary for support, safety, fraud review, enforcement, or legal compliance.
You represent that you have the rights needed to submit your User Content and that it is accurate, lawful, and does not violate another person’s privacy, publicity, intellectual-property, or other rights.
Eligible reviews must reflect the reviewer’s genuine experience. We may remove or restrict reviews that are fraudulent, coercive, irrelevant, abusive, disclose private information, or otherwise violate these Terms. A Creator may be allowed to publish or unpublish an eligible review but may not edit the Follower’s words or rating.
Creator profiles are Company-controlled public pages. Public content may be indexed, copied, or cached by search engines or other third parties.
Creators may author intake questions only to request limited information reasonably related to a lawful, Company-authorized service. Creators may not ask for, and Followers may not submit through an intake form, medical records, government-issued identification or identification numbers, payment-card or financial-account details, passwords or authentication codes, biometric information, or other sensitive personal information. Intake responses are not a substitute for medical, mental-health, legal, financial, or emergency services.
11. Acceptable Use and Prohibited Services
You may not use or attempt to use the Service—including any profile, intake form or response, offer, booking request, custom request, session, message, review, Tribute, or arrangement initiated through the Service—to offer, request, advertise, arrange, provide, purchase, or pay for:
- activity that violates law, sanctions, export controls, court orders, or another person’s rights;
- fraud, deception, impersonation, money laundering, card testing, unauthorized transactions, chargeback abuse, or false credentials;
- prostitution, escort services, sexual services, sexual massage, fetish services or fulfillment, adult live chat or video, paid companionship intended for sexual gratification, pornography, or sexually explicit text, imagery, audio, video, performance, roleplay, instruction, or other material intended for arousal or sexual gratification, including AI-generated or materially altered content;
- sexual exploitation, sexual content involving a person under 18, or any attempt to sexualize, groom, solicit, or endanger a minor;
- medical diagnosis or treatment, telemedicine or telehealth, psychotherapy, crisis care, legal advice or representation, investment or trading advice, cryptocurrency advice or signals, lending, credit repair or counseling, debt relief, settlement, consolidation, or collection, mortgage consulting, escrow, money transmission, currency exchange, or another regulated professional or financial service;
- matchmaking, arranging romantic introductions, or operating an online dating service;
- gambling, betting, lotteries, raffles, sweepstakes, fantasy sports, tournaments, contests, auctions, forecasting, or other activity involving an entry fee or a monetary or material prize;
- illegal drugs, cannabis or marijuana products, CBD products, drug-production or cultivation instruction, tobacco or vaping products, weapons, explosives, dangerous materials, counterfeit goods, infringing material, fake identification or documents, or unlawful violence or physical harm;
- pyramid or multilevel-marketing schemes, get-rich-quick programs, guaranteed-result schemes, fake or deceptive testimonials, misleading or high-pressure upselling, hidden or negative-option pricing, document-falsification services, or the sale of followers, traffic, or engagement;
- crowdfunding, charitable fundraising, undisclosed donations, personal gifts, peer-to-peer transfers, cash advances, cash equivalents, stored value, gift cards, virtual credits, Creator balances, withdrawals, or payments collected for another person or merchant;
- exclusive Creator content or digital goods, pay-per-view access, content or message unlocks, or content-related payments other than a Tribute permitted under Section 8;
- harassment, threats, exploitation, discrimination, stalking, doxing, or abuse of another person;
- payment solicitation outside the Company’s approved checkout, evasion of Company controls, or redirection of a Follower to an undisclosed seller;
- scraping, harvesting, sale, or misuse of personal information or confidential communications;
- requesting or submitting medical records, government-issued identification or identification numbers, payment-card or financial-account details, passwords or authentication codes, biometric information, or other sensitive personal information through an intake form;
- malware, security probing, bypassing access controls, overloading systems, unauthorized automation, or reverse engineering of protected elements of the Service;
- spam or deceptive commercial messages;
- infringement of intellectual-property, privacy, publicity, confidentiality, or contractual rights; or
- any product, content, service, transaction, or business that Stripe identifies as prohibited, or as restricted unless the Company has received any required written approval and has expressly authorized the activity in writing.
These categories are illustrative, not exhaustive. We may reject or remove content, cancel or refund transactions, restrict features, or suspend or terminate access when reasonably necessary to comply with law, Stripe or card-network requirements, Company policy, or risk controls.
Non-explicit sessions may address dating, communication, relationships, general wellbeing, mentorship, creative feedback, or education only in a general informational manner. They may not include nudity, erotic roleplay, sexualized interaction, fetish fulfillment, explicit sexual instruction or conversation, or material intended for arousal or sexual gratification. General guidance, mentorship, creative feedback, and educational discussion are not medical care, therapy, legal advice, or financial advice.
12. Moderation, Reports, and Enforcement
We may investigate reports, restrict content, pause payments, cancel requests, suspend accounts, preserve evidence, or terminate access when reasonably necessary to protect users, the Company, Stripe, payment networks, or the public; enforce these Terms; or comply with law.
We are not obligated to monitor every interaction. Failure to take action in one instance does not waive our right to act later. You agree to cooperate with reasonable fraud, safety, refund, dispute, and legal investigations.
13. Intellectual Property
The Service, including its software, design, branding, logos, compilation, and Company-created content, is owned by or licensed to Tribute.tips and is protected by intellectual-property laws. Except for the limited right to use the Service under these Terms, no right is granted to you.
You may not use the Tribute.tips name, marks, domain, or Creator profile materials in a way that implies endorsement, creates confusion, or violates law without written permission.
If you believe content on the Service infringes your copyright, contact legal@tribute.tips and identify the copyrighted work, the material at issue and its location, your contact information, and the basis for your concern. We may request additional information and may remove or restore material as applicable law requires. This contact process does not represent that the Company has completed any separate statutory service-provider registration.
14. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect personal information. It is incorporated into these Terms by reference. By using the Service, you acknowledge the practices described in that policy.
15. Third-Party Services
The Service may link to or depend on Stripe and other third-party services. We do not control a third party’s independent services, terms, availability, security, or privacy practices. A link or integration does not imply that the third party endorses Tribute.tips.
16. No Professional Advice; Assumption of Responsibility
Sessions are for general informational, educational, creative, mentorship, or guidance purposes only. They are not medical care, mental-health treatment, crisis intervention, legal advice, financial advice, or another regulated professional service.
You remain responsible for your own decisions, actions, safety, health, finances, relationships, and results. Do not disregard professional advice or delay seeking qualified assistance because of a session. If you face an emergency or crisis, contact appropriate emergency or crisis resources rather than the Service.
17. Disclaimers
To the maximum extent permitted by law, the Service is provided as is and as available. We do not warrant uninterrupted or error-free operation, universal availability, a particular Creator’s availability, or any specific personal, business, financial, health, relationship, or other outcome.
We do not disclaim warranties or consumer protections that cannot lawfully be disclaimed. Some jurisdictions may give you rights that override part of this Section.
18. Limitation of Liability
To the maximum extent permitted by law, Tribute.tips and its owners, officers, employees, contractors, agents, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or business interruption arising from the Service, even if advised that such damages are possible.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of:
- the amount you paid to the Company through the Service during the six months before the event giving rise to the claim; or
- one hundred U.S. dollars (US $100).
These limitations do not apply to liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits limitation.
19. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Tribute.tips and its owners, officers, employees, contractors, agents, and affiliates from third-party claims, damages, losses, liabilities, and reasonable costs arising from your unlawful conduct, your material breach of these Terms, your infringement of another person’s rights, or your User Content.
This Section does not require a consumer to indemnify the Company for the Company’s own negligence, willful misconduct, or violation of law.
20. Suspension and Termination
You may stop using the Service at any time and may request account closure by emailing privacy@tribute.tips. Closure is subject to pending transactions and the retention exceptions described in the Privacy Policy. We may suspend or terminate access, cancel pending activity, or restrict features if you breach these Terms, create risk, fail verification, misuse payments, or if continued service is unlawful or operationally impracticable.
Termination does not eliminate obligations or rights that accrued earlier. Sections that by their nature should survive—including payment, refunds, intellectual property, confidentiality, disclaimers, liability limitations, indemnification, dispute provisions, and records—will survive.
21. Changes to the Service or Terms
We may change the Service and these Terms. The updated Terms will identify a revised Last Updated date. If a change materially affects your rights, we will provide reasonable notice or request renewed acceptance where required by law. Changes apply prospectively unless law permits otherwise.
Your continued use after an updated version becomes effective constitutes acceptance when legally permitted. A transaction remains subject to the version accepted when the transaction was made unless the parties agree otherwise or law requires a different result.
22. Governing Law and Courts
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except that applicable federal law and non-waivable consumer protections of your home jurisdiction continue to apply.
Any claim arising out of or relating to these Terms or the Service that is not resolved informally must be brought in a state or federal court located in the State of Delaware, and each party consents to personal jurisdiction and venue there, except where applicable law gives a consumer a non-waivable right to bring a claim elsewhere.
These Terms do not require arbitration and do not waive any right to participate in a class action.
23. General Terms
Entire agreement. These Terms, the Privacy Policy, applicable transaction details, and any additional terms you expressly accept form the agreement between you and the Company regarding the Service.
Order of priority. Transaction-specific terms control over these Terms only for that transaction and only to the extent of a direct conflict.
Assignment. You may not assign your rights or obligations without our written consent. We may assign these Terms in connection with a merger, reorganization, financing, sale of assets, or transfer of the Service, subject to applicable law.
Severability. If a provision is held unenforceable, it will be enforced to the greatest lawful extent and the remainder will remain effective.
No waiver. A failure to enforce a provision is not a waiver.
Force majeure. Neither party is liable for delay caused by events beyond reasonable control, but this does not eliminate the Company’s obligation to provide any refund required by these Terms or law.
Headings. Headings are for convenience and do not limit meaning.
Electronic records. You consent to electronic agreements, notices, receipts, and records that you can retain. You may withdraw consent to future electronic transactions by closing your account, but withdrawal does not affect prior transactions.
